Las apps surgieron con la idea de ofrecer un servicio especializado y adecuado a la tecnología móvil. De acuerdo con datos de la Unidad de Inteligencia Competitiva (CIU), en la primera mitad de 2019 fueron contabilizados 106.8 millones de dispositivos activos en México.
En consecuencia, han incrementado constantemente los usuarios que utilizan aplicaciones móviles, principalmente gratuitas. La CIU añadió que han sido registrados 95.3 millones de consumidores en el país, con un incremento anual de 2.4 millones de cibernautas.

Por lo que la firma legal BC&B destaca la importancia de su adecuada protección legal, ya que México es el país que cuenta con mayor cantidad de descargas de apps (más de 34.6 millones) en América Latina.
“Debido a la falta de la cultura de protección [los emprendedores] comúnmente no se ocupan de este aspecto, por lo que existe el gran riesgo de que poco después de su lanzamiento, la competencia copie el nombre, aspecto y función de estas”, señaló Mariana González, socia de BC&B.
BC&B comparte 8 aspectos que todo emprendedor debe tomar en cuenta para proteger su app:
- Contratos de propiedad: Con relación al diseño y desarrollo de la app es necesaria la colaboración de diversas personas. Por tanto, es indispensable establecer contratos que indiquen quién es el propietario para que el personal no pueda reclamar eventualmente el dominio sobre el producto.
- Sistema de programación: En caso de utilizar software de código abierto, es importante considerar que normalmente está acompañado de permisos de uso que pueden restringir su manejo comercial o limitar su desarrollo. Entonces, es necesario investigar los tipos de licencia disponibles y escoger cuáles serán aplicadas al código de la app.
- Secreto Industrial: Este aspecto, el cual representa una ventaja competitiva para las empresas, comprende la información de datos corporativos, clientes, análisis, algoritmos y estrategias comerciales. Para que funcionen correctamente, estos aspectos deben estar identificados, documentados y en confidencialidad, ya que permitirán gestionar el flujo de información dentro y fuera de la empresa.
- Diseño Industrial: Las características visuales (conjuntos de íconos, pantallas, imágenes dinámicas), las cuales no necesariamente sirven para distinguir una app de otras, pero proporcionan un aspecto peculiar, pueden ser protegidas mediante el diseño industrial, el cual es menos costoso y cuentan con una vigencia de 25 años.
- Derechos de autor: El contenido de la aplicación (código, fuente, imágenes) puede ser protegido mediante esta figura jurídica, la cual es automática y gratuita porque surge cuando la app tiene forma tangible. Sin embargo, hacer el registro formalmente brinda protección y derechos más sólidos que duran hasta 100 años después de la muerte del autor.
- Marca: La identidad de la aplicación puede protegerse mediante este modelo, el cual evitará que las características (nombre, slogan, apariencia del ícono, interfaz, etc.) sean utilizadas por la competencia. La solicitud tarda menos de un año y cuenta con un periodo de protección de 10 años que puede ser renovado por el mismo término.
- Patentes: Es la protección con mayor amplitud, pues puede cubrir su funcionalidad por 20 años. Las apps que sólo recopilan y muestran datos, o automatizan procesos conocidos, probablemente sean consideradas materia no patentable. Sin embargo, aquellas que resuelven una necesidad o causan un cambio en el mundo real pueden patentarse, siempre y cuando sean novedosas e inventivas.
- Términos y condiciones: Finalmente, debe establecerse un conjunto de puntos que determinen la forma en cómo los usuarios pueden usar el contenido (tal como descargar material para uso personal y educativo, pero no con fines comerciales) y de qué manera serán manejados sus datos personales conforme a la ley aplicable.
“Vivimos en un mundo acelerado, y obtener protección sobre una app desde un principio ayudará a asegurar el trabajo, tiempo y dinero invertido desde su concepción hasta el diseño de la forma más adecuada. Protegerla utilizando diferentes figuras de propiedad intelectual, y otras estrategias como contratos, maximizará su valor al blindarla de tal forma que nadie la copiará, ni afectará su penetración en el mercado”, añadió Mariana González.
